You Have Declared, He Has Declared

12 When you have finished tithing all the tithe of your increase in the third year, which is the year of tithing, then you shall give it to the Levite, to the foreigner, to the fatherless, and to the widow, that they may eat within your gates and be filled. 13 You shall say before Yahweh your God, “I have put away the holy things out of my house, and also have given them to the Levite, to the foreigner, to the fatherless, and to the widow, according to all your commandment which you have commanded me. I have not transgressed any of your commandments, neither have I forgotten them. 14 I have not eaten of it in my mourning, neither have I removed any of it while I was unclean, nor given of it for the dead. I have listened to Yahweh my God’s voice. I have done according to all that you have commanded me. 15 Look down from your holy habitation, from heaven, and bless your people Israel, and the ground which you have given us, as you swore to our fathers, a land flowing with milk and honey.” 16 Today Yahweh your God commands you to do these statutes and ordinances. You shall therefore keep and do them with all your heart and with all your soul. 17 You have declared today that Yahweh is your God, and that you would walk in his ways, keep his statutes, his commandments, and his ordinances, and listen to his voice. 18 Yahweh has declared today that you are a people for his own possession, as he has promised you, and that you should keep all his commandments. 19 He will make you high above all nations that he has made, in praise, in name, and in honor, and that you may be a holy people to Yahweh your God, as he has spoken.

A second confession certifies that the poor were paid, and the covenant closes with two declarations made on the same day.

The second liturgy belongs to the third year, when the tithe stays in the town and feeds the Levite, the foreigner, the fatherless, and the widow Deuteronomy 26:12.

What the giver says is a sworn statement of compliance: I have put away the holy things out of my house, and also have given them... according to all your commandment Deuteronomy 26:13.

The details he certifies are oddly specific — he has not eaten of it while mourning, nor handled it while unclean, nor given any of it for the dead Deuteronomy 26:14. The last clause rules out diverting the poor's portion into funerary offerings, which was a common use of food in the surrounding cultures.

What makes the passage remarkable is that this is a declaration made to God about the treatment of four people who cannot enforce anything. Nobody audits a farmer's third-year tithe. The system runs on a statement made aloud at the sanctuary by a man who could have lied, and the law supplies the words for him.

Only after making it does he ask for anything: look down from your holy habitation, from heaven, and bless your people Israel, and the ground Deuteronomy 26:15. The blessing is requested for the nation and the soil, not for himself.

The chapter then closes the entire law section, and it does so with a pair of sentences that read like the signing of a document.

You have declared today that Yahweh is your God, and that you would walk in his ways, keep his statutes, his commandments, and his ordinances, and listen to his voice.

Two declarations, on the same day, in matching form. Each party states what it is undertaking, and the symmetry of the wording is the point — this is an agreement being executed rather than terms being imposed. The word today appears in both.

And the outcome promised is not comfort. God will make them high above all nations that he has made, in praise, in name, and in honor, so that they may be a holy people Deuteronomy 26:19. Distinction rather than ease, and the purpose clause comes last.
